1. Acceptance of Terms

By accessing, Browse, or using the website arthurparish.com (the “Site”), or by purchasing products from the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not use or access the Site.

2. Definitions

  • “Site” refers to the website arthurparish.com, operated by Parish Digital Media.
  • “We”, “Us”, “Our” refers to Parish Digital Media (ABN 17 564 033 719).
  • “User”, “You”, “Your” refers to any visitor, browser, or customer of the Site.
  • “Products” refers to the goods and services available for purchase on the Site, including print-on-demand paperback books fulfilled by Amazon and digital downloads fulfilled via Easy Digital Downloads.
  • “Content” refers to all text, graphics, logos, images, software, and other materials on the Site.

3. License for Digital Products

Upon purchase of a digital Product (e.g., an ebook), we grant you a single, non-exclusive, non-transferable, revocable license to use the Product for your personal, non-commercial use only. You agree not to copy, reproduce, distribute, sell, sublicense, modify, or create derivative works from the digital Product.

4. Purchases and Payment

To purchase Products, you must provide a valid email address for order fulfillment and communication. No user account registration is required. All prices on the Site are listed in Australian Dollars (AUD) and are inclusive of GST where applicable. Payment is processed through our third-party payment gateways, Stripe or PayPal. By making a purchase, you agree to abide by the terms and conditions of the relevant payment processor.

5. Shipping and Fulfilment

Physical book Products are produced and fulfilled by Amazon’s Print-on-Demand (POD) service. All aspects of shipping, including costs, delivery times, tracking, and handling, are governed by Amazon’s shipping terms and policies. We are not responsible for any delays, damages, or other issues related to the shipping and delivery of physical Products. Any queries regarding the shipment of a physical book should be directed to Amazon.

6. Refunds and Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.

In addition to your rights under the ACL, we offer a thirty (30) day refund window from the date of purchase for change of mind, subject to the following:

  • For digital Products, a refund may be conditional on you not having downloaded the file.
  • For physical Products, the item must be returned in its original condition, at your expense.

This change-of-mind policy does not limit or replace your rights under the Australian Consumer Law.

7. Intellectual Property

All Content on the Site, including text, graphics, logos, button icons, images, and the compilation thereof, and all software and Products sold on the Site, is the property of Parish Digital Media or its content suppliers and is protected by Australian and international copyright and trademark laws.

The trademarks, logos, and service marks of third parties, including “Amazon,” “Stripe,” “PayPal,” and “WordPress,” are the property of their respective owners.

8. Limitation of Liability

To the maximum extent permitted by law, Parish Digital Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Site or your purchase or use of any Products.

In no event shall our aggregate liability for all claims relating to the services exceed the total amount paid by you to us for the Products in question.

This clause does not limit or restrict any of your rights or any of our obligations under the Australian Consumer Law.

9. Indemnity

You agree to indemnify, defend, and hold harmless Parish Digital Media and its owner, agents, and affiliates from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site, your violation of these Terms, or your misuse of any Products.

10. Governing Law and Jurisdiction

These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of the State of South Australia, Australia. You irrevocably submit to the exclusive jurisdiction of the courts of South Australia.

11. Dispute Resolution

Before commencing any legal proceedings, you agree to first notify us of the dispute by sending an email to arthur@arthurparish.com and attempt to resolve the dispute with us through good faith negotiation. If the dispute is not resolved within thirty (30) days of such notification, either party may then proceed to resolve the dispute in the courts of South Australia.

For unresolved consumer-related disputes, you may also refer the matter to the Australian Competition and Consumer Commission (ACCC).

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the revised Terms on the Site, with the “Effective Date” at the top updated accordingly. Your continued use of the Site after such changes are posted constitutes your acceptance of the new Terms.
